If any cargo damaged or lost in the care of Yang Ming, the cargo interest may have a claim against Yang Ming as the carrier. Yang Ming would like to resolve any possible claim as accurately and as quickly as possible. To ensure an efficient handling of your claim, we describe our claims process as following for your reference:

Report the loss or damage immediately upon taking delivery of cargo. While the shipment is insured, you should first contact your insurance company and report the loss or damage to them, and then notify Yang Ming (or its agent).
(2)
Survey for the damaged cargo (preferably while the cargo is still untouched). If possible, this should be a joint survey together with Yang Ming.
(3)
The extent and possible cause of the damage have to be considered before submitting a fully-documented claim with your insurance company, or Yang Ming directly if your cargo is not insured.
(4)
A well-documented claim will facilitate the handling process and speed up the outcome, therefore the documentation should be consisted of the followings in your claim.
a.Statement of claim (claim amount and cause of ...damage) b.Yang Ming's Bill of Lading c.Cargo invoice (showing value of cargo) and packing list d.Survey report or damage report e.Disposal/destruction certificate or proof of salvage ...value, if any

When Yang Ming receives the claim, we will acknowledge receipt and the claim will then be processed. The time limitation of acceptance will be one year after delivery of the Goods or the date when the Goods should have been delivered according to the terms and conditions of Yang Ming's Bill of Lading and/or related international/local law.

Yang Ming will let you know our findings as soon as possible. In general, the claim will be assessed according to legal liability as set forth in Yang Ming's Bills of Lading, tariffs, and by-law and will be settled within 90 working days after receiving your fully-documented claim, except where Yang Ming has demonstrated active discussions and/or communication(s) with claimant due to extreme circumstances.

If Yang Ming is liable for the cargo damaged or loss, Yang Ming will arrange the payment as soon as possible.
Yang Ming's position on Liability of cargo loss/damage will comply with terms and conditions of reverse side of Yang Ming's Bill of Lading and related international/local law such as Hague and Hague-Visby Rules, USA COGSA etc..
Upon picking up empty container or stuffing your goods to container, please ensure that for all kinds of cargo

you use a suitable container size and type
(2)
the containers are in a clean, odor free and sound
condition before stuffing
(3)
the container is stuffed in a proper and secure manner
so that the cargo cannot shift during transportation
(4)
the container is properly closed and sealed for Reefer
container shall plus :
(5)
make a physical inspection to ensure the actual
temperature/ventilation setting
(6)
pre-cool your cargo to the correct set temperature
(7)
do not mix incompatible cargoes in the same container
(8)
do not stuff the cargo above the red load line
(9)
haulage of laden reefer container to/from port must use a generator
